Terms of Service

Welcome to Volii (the "App"). These Terms of Service ("Terms") govern your access to and use of the App. "We," "us," and "our" refer to the operator of Volii. By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old to use the App. By creating an account, you represent that you meet this requirement.

2. Account Registration

Accounts are per club. To use the App, you must create an account using a valid email address, password, and name, and every account belongs to a specific club, so the same email address may hold accounts in more than one club. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Providing accurate information when creating your account

Notify us immediately at support@volii.io if you suspect unauthorized access to your account.

3. Description of the App

The App allows users to log recreational racket-sports games, including scores, participants, and related activity data. Depending on your club's plan it also schedules sessions, tracks ratings and achievements, runs tournaments and seasons, and records who owes what for shared costs such as court rental fees.

Important: the App does not process, hold, or transmit any payment between users. Any cost-splitting information (such as an e-transfer email) is provided for the users' own reference and convenience only. Any actual payment, e-transfer, or financial transaction between users happens entirely outside the App, through third-party services (such as your bank or e-transfer provider), and is solely between the users involved. Subscription payments to us are a separate matter, described in section 5.

4. Plans

The App is offered on the following plans:

• Free. No charge, no time limit, and no card required. A club on the Free plan may have up to 4 players, and gets unlimited game logging, singles and doubles ratings, the leaderboard, and player profiles.
• Friend Group. $15 USD per month, or $150 USD per year. A club on this plan may have up to 20 players and has access to every feature of the App, including sessions and cost splitting, achievements, milestones and titles, seasons, tournaments, and weather.
• Larger clubs. Clubs above 20 players are priced individually. Those arrangements are set out in a separate order form or written quote, which prevails over these Terms where the two conflict.

A "player" means anyone on your club's roster, whether or not they have signed in to claim their account. Prices are stated in US dollars and exclude sales tax, which is calculated at checkout based on your billing address and shown before you pay.

5. Subscriptions, Billing and Automatic Renewal

Payments are processed by Stripe. We never see or store your full card details. By subscribing you authorize us, through Stripe, to charge your payment method on the following basis:

• Payment is in advance. A monthly subscription is charged when it starts and on the same day each month afterwards; an annual subscription is charged when it starts and on the same date each year.
• Subscriptions renew automatically for the same period, at the same price, until you cancel. You do not need to do anything to continue, and we do not ask you to confirm each renewal.
• You can cancel at any time from your billing page inside the App, as described in section 7.
• Before an annual renewal we send you a reminder by email stating the date and the amount.
• You may switch from monthly to annual billing at any time. The unused part of the month you have already paid for is credited against the price of the year.

If a payment fails, we will retry it over approximately two weeks and email you about it. Your club keeps full access during that period. If no payment succeeds, the subscription ends and your club moves to the Free plan, as described in section 8.

6. Free Trial

A club may take one free trial of the Friend Group plan, lasting 20 days. The trial requires no credit card, has no player limit while it runs, and includes every feature of the App. Nothing is charged at the end of a trial and it does not convert into a paid subscription by itself: when it ends, your club moves to the Free plan unless you have chosen to subscribe.

7. Cancellation

You can cancel your subscription yourself, at any time, from the billing page in the App. No phone call, no email, and no request to us is required.

Cancelling stops the next renewal. You keep full access for the rest of the period you have already paid for, whether that is a month or a year, and your club moves to the Free plan when that period ends. You can resume before it ends with a single click, and you can subscribe again at any time afterwards.

8. What Happens on the Free Plan

Nothing you have logged is deleted when a subscription or trial ends. Your games, ratings, leaderboard and player profiles keep working, and no player is removed from your roster. Features that belong to the Friend Group plan, including sessions, achievement and milestone visibility, seasons, tournaments and weather, stop being shown until you subscribe again.

If your club has more than 4 players, it becomes read-only until you subscribe. Everything remains visible and nothing is lost, but new games and other new data cannot be added. We do not ask you to remove players from your club to fit the Free plan.

9. Refunds

Subscriptions renew automatically, and you can cancel anytime from your billing page. When you cancel, you keep full access until the end of the period you've paid for (month or year); we don't automatically refund unused time. If something went wrong (a double charge, a billing error, you forgot to cancel and never used it) email support@volii.io and we'll make it right. Nothing in this policy limits rights you have under applicable consumer protection law.

10. Price Changes

We may change our prices. If we do, we will give you at least 30 days' notice by email before the new price applies to your club, and the new price takes effect on your next renewal after that notice. You can cancel before then if you do not want to continue at the new price. A price change never applies to a period you have already paid for.

11. User Content

"User Content" means any information you submit to the App, including game logs, scores, names, and cost-splitting notes. You retain ownership of your User Content. By submitting User Content, you grant us a non-exclusive, royalty-free license to store, display, and process it for the purpose of operating and improving the App.

You are responsible for the accuracy of the User Content you submit, including any names or references to other individuals (e.g., logging a game with another user's name). Do not submit content that is false, defamatory, or that violates another person's privacy or rights.

12. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Impersonate another person or misrepresent your affiliation with any person
• Submit false game data, financial references, or information intended to mislead another user (e.g., providing an incorrect payment reference)
• Attempt to interfere with, disrupt, or gain unauthorized access to the App or its systems
• Use the App to harass, defame, or harm another user

13. Your Reviews and Public Comments

You are free to publish your honest opinion of Volii, publicly and anywhere, whether or not it is complimentary. Nothing in these Terms restricts you from reviewing, criticizing, or discussing the App, and we will not ask you to take a review down as a condition of support, a refund, or continued service.

14. No Involvement in Court Bookings or Payments Between Users

The App is a logging and record-keeping tool. We do not:

• Book, reserve, or facilitate access to any court, facility, or rec center
• Process, guarantee, hold, or verify any payment or e-transfer between users
• Mediate disputes about money owed, split costs, or reimbursement between users

Any arrangement to split costs, send an e-transfer, or book a court is solely between the users involved. We are not responsible for any unpaid amounts, incorrect transfers, disputes, or losses arising from cost-splitting arrangements or court bookings made outside the App.

15. Assumption of Risk

Pickleball and other physical activities carry inherent risks of injury. The App is a game-logging tool and does not organize, supervise, referee, or provide instruction for any game or activity. You acknowledge and agree that:

• You participate in any physical activity logged in the App entirely at your own risk
• We are not responsible for any injury, loss, or damage arising from games, matches, or activities you log or reference through the App
• The App is not a substitute for appropriate safety precautions, equipment, or medical advice

16. Termination

We may suspend or terminate your account at any time if you violate these Terms. If we terminate a paid club's account for a reason other than a violation of these Terms, we will refund the unused part of the period it has paid for. You may delete your account at any time by contacting support@volii.io. Upon termination, your right to use the App ends, though we may retain certain data as described in our Privacy Policy or as required by law, including billing and tax records.

17. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the App will be uninterrupted, error-free, or secure.

18. Limitation of Liability

To the fullest extent permitted by law, Volii and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising from your use of the App, including, without limitation, any disputes, losses, or injuries connected to games logged, cost-splitting references, or court bookings arranged outside the App. Where liability cannot be excluded, our total liability is limited to the amount your club paid us in the twelve months before the event giving rise to the claim.

19. Indemnification

You agree to indemnify and hold harmless Volii from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the App, your User Content, or your violation of these Terms.

20. Clubs Using Volii as a Business or Organization

If your club subscribes through an organization, employer, or league budget rather than as an individual consumer, sections 17 to 19 apply in full and consumer-specific protections may not be available to that organization. Where we have signed an order form or written quote with your club, that document prevails over these Terms to the extent of any conflict.

21. Changes to the App or These Terms

We may update these Terms from time to time. For changes that materially affect your rights or what you pay, we will give you at least 30 days' notice by email to your account address, or by a notice inside the App, before they take effect. Continued use of the App after that date constitutes acceptance of the updated Terms. If you do not accept them, you can cancel your subscription and stop using the App, and the version of these Terms you agreed to continues to apply until the change takes effect. Minor changes, such as corrections, clarifications, or new features that do not reduce your rights, may take effect immediately.

22. Governing Law

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict-of-law principles.
